The California Fish and Game Commission is considering the following changes to Title 14 of the California Code of Regulations. A business or a person submitting a comment to a proposed regulation or proposed amendment or repeal of a regulation has the right to request a copy of the final statement of reasons. Copies of the final statements of reasons will be available on this web page as they are prepared. Requests may also be submitted to the California Fish and Game Commission, 1416 Ninth Street, Room 1320, Sacramento, CA 95814.

Adoption Date: At its October 6, 2006 meeting, the Fish and Game Commission adopted the proposed changes to the Market Squid Fishery regulations to establish a Non-transferable Market Squid Light Boat Permit class (Item 1 of the proposal); update the log book form and add it to the Appendix in Title 14 (Item 3 of the proposal); and make amendments for clarity and consistency. The Commission took no action on the adjustment of Market Squid Permit fees (Item 2 of the proposal). Since the Commission did not adopt a fee for the newly established Non-transferable Market Squid Light Boat Permit class, the fee for this permit will be $30.00, pursuant to subsection (b) of Section 699, Title 14, CCR. Because the modified proposed regulations are different from, yet sufficiently related to, the originally proposed regulations, the Administrative Procedure Act requires that these changes be made available for a 15-day written comment period. The Commission confirmed its October 6, 2006 action at its November 3, 2006 meeting.

Minor changes to the regulatory language approved October 6 and confirmed November 3 are necessary. Because the modified proposed regulations are different from, yet sufficiently related to, the originally proposed regulations, the Administrative Procedure Act requires that these changes be made available to you for a 15-day written comment period. The Commission is proposing to revise the proposed regulatory language in subsection (d) of Section 53.03 to reflect that the effective date of the regulations which establish the Non-transferable Market Squid Light Boat Permit class will be upon filing of the regulations with the Secretary of State. The Commission’s October 17, 2006 notice stated the fee in Section 149.1(i)(F) would be $30.00 pursuant to Section 699, Title 14, CCR; however, after being adjusted for inflation pursuant to Section 713 of the Fish and Game Code, the fee will be $40.50. The date of the form listed in 149.1(d)(2) is being updated. If needed to comply with statutory requirement, a teleconference hearing relevant to this action will be held on December 21, 2006.
