Mike Rees asked if the Department accepted NMFS studies and resultant data on salmon and habitat or does it do its own studies.

Deputy Director Mastrup responded that the Department is part of the Council process providing data but not publishing its own report.

Walt Mansell spoke on fire proofing our forests, alternative solutions to the proposed mile wide firebreak, and the decision by the National Park Service to remove big game animals from the Channel Islands. He suggested that utilization of sport hunters would be a better alternative.

Dr. Rick Staub requested an update on his proposal to the Department to add the California Mountain King Snake and the Rubber Boa to the Captive Propagation Permit. He suggested a reptile collection license or stamp. He proposed the addition of the Southern Water Snake to the Detrimental Species List.

President Flores asked Deputy Director Mastrup for the status of Dr. Staub’s proposal.

Deputy Director Mastrup responded that reptile concerns are low-priority issues and that now Dr. Staub has submitted the CEQA document, the Department will move forward with his request.

Commissioner Gustafson questioned the protocol for establishing priorities.

Commissioner Rogers suggested informal meetings with Department staff to research solutions for establishing priorities.

Commissioner Gustafson requested a timeline from the Commission staff regarding the facts associated with this proposal so that the Commissioners could review it to determine a more efficient course of action.

Christopher Voss spoke on the proposed abalone fishery at San Miguel Island. He explained that CAA developed a MOA between the Department and CAA but the DFG legal staff rejected it. He requested the Commission to direct the Department to work with their lawyers in developing language that meets the necessary legal requirements so that monies allocated to the organization can be utilized.

Robert Treanor stated that an MOU was done for the sea urchin fishery.

Commissioner Rogers questioned Deputy Director Mastrup regarding the status of this proposal.

Deputy Director Mastrup responded that the MOA concept is no longer legal under the new administrative procedures rules. He indicated that the Department would continue to move forward with finding a solution.

April Wakeman requested an update from the Department on the implementation of the halibut-trawl bill at the Commission’s June meeting.

Tom Raftican requested that the Commission hold the Department accountable for implementation of the halibut-trawl fishing bill because it is budgeted at $25 billion annually.

Deputy Director Mastrup stated that the Department has responded in writing to the UASC indicating that it does not have the resources to implement the bill.

John Duffy supported amendments to regulations regarding light boat permits and sea urchin.

Executive Director John Carlson indicated that these items will be addressed under Agenda Item 5.

Paul Weakland expressed his concerns regarding the turban snails fishery and the cancellation of the May Marine Resources Committee Meeting.

Bob Strickland thanked the Department and the Commission for progress with surfperch regulations which will be implemented on May 21 and asked the Commission to develop a halibut fishery management plan that would benefit recreational anglers.

Jim Martin provided the Commission with a handout containing public testimony on sturgeon regulations.
